The present General Terms and Conditions of Sale govern the commercial relations between SAS VIF Systems (hereinafter referred to as " Prêt à Pousser ") and any person making a purchase on the site (hereinafter referred to as the "Customer"). They apply for the duration of their publication on pretapousser.fr. Prior to payment, the Customer acknowledges having read the General Terms and Conditions of Sale on the www.pretapousser.fr website. Acceptance of the General Terms and Conditions of Sale by the Customer is evidenced by ticking a box on each order: "I accept the General Terms and Conditions of Sale". These general terms and conditions of sale shall prevail over any other conditions appearing in any other document, except with the prior, express and written agreement of Prêt à Pousser. Prêt à Pousser reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer's order.
The Products sold by Prêt à Pousser are manufactured with care and packaged with care. If, however, the Product does not function properly, the Customer is invited to contact the Prêt à Pousser After Sales Service, which will provide recommendations for the correct functioning of the Product.

Photographs, films, videos, diagrams or drawings of products Prêt à Pousser are not contractual. The essential characteristics of the products are indicated in their respective descriptions, which are the only contractual source. Our product and price offers are valid for the duration of their publication, unless otherwise specified.
The Customer has the possibility to pre-order a Product before its commercialisation. He/she places the pre-order like any other order but will only be delivered from the month mentioned on the description of the Product.
In order to place an order on the www.pretapousser.fr website, it is necessary to create an account beforehand, either before placing the order or during the ordering process, by clicking on "Create an account". Certain information is compulsory and is therefore necessary for the processing of the Customer's order. Consequently, in the event of an error in the Customer's contact details, www.pretapousser.fr is not responsible for the impossibility of delivery of the order.
The Customer may, at any time, modify the information provided. The information given by the Customer when placing an order is binding. The Customer can view all his invoices in my account.
Placing and validating an order
In order to build up his basket, the Customer chooses the desired quantities of the product, then validates by clicking on the "Add to basket" button. On the basket screen, the Customer may, at any time, modify the quantities or exit to return to the shop. By clicking on the "Proceed to checkout" button, the Customer can then validate the delivery and billing addresses. In order to validate the order and pay, the Customer must click on the "Pay" button. A summary of the order shows the number of products chosen, the cost of delivery and the total to be paid. The last screen allows the registration of his bank details. After validation of the order by the bank payment service, the Customer receives an order confirmation by email. Pretapousser.fr will inform the Customer by email of any stock shortages that may affect his order. Pretapousser.fr reserves the right to cancel any order from a Customer in case of breach by this Customer of its contractual obligations under this order and / or the previous order. The information provided by the Customer when placing the order is binding on the Customer: in case of error in the address of the recipient, Prêt à Pousser can not be held responsible for the impossibility in which it could be to deliver the product. Pretapousser.fr being a retail website, Prêt à Pousser reserves the right not to follow up on orders for identical products in large quantities.
Delivery is made either by direct delivery to the Customer or by notification of availability at a post office in the event of absence.
Delivery is made to the address indicated by the Customer when placing the order. Prêt à Pousser undertakes to deliver to the Customer within a maximum of 15 days from the day following that on which the Customer placed the order. All other delivery times are given as an indication only; the times indicated on the site are average times usually observed and correspond to order processing times, to which must be added the shipping time of the carriers.
In the event of a delay in delivery, we advise the Customer to check the status of their order directly online before contacting us on the carrier's website using the shipment number if available. We invite the Customer to inform us of any delay of at least one week in relation to the average delivery time noted, so that we can start an investigation with the carrier (investigation times can vary from one to three weeks). If, during the investigation period, the Product is found, it will be immediately redirected to the address given by the Customer at the time of ordering. On the other hand, if the Product is not found at the end of the investigation period, the carrier will consider the parcel as lost and Prêt à Pousser will send a replacement Product, at its expense. If the time limit indicated is exceeded by more than 7 days, except in cases of force majeure (carrier strike, accident -not an exhaustive list-), the Customer has the possibility of cancelling the order and being reimbursed; the Customer must then send a registered letter with acknowledgement of receipt to Prêt à Pousser within 60 working days of the planned delivery date. By express agreement, in the event of force majeure (as recognised by French jurisprudence), Prêt à Pousser is released from all responsibility for delivery. In all cases, delivery within the deadlines can only take place if the Customer is up to date with his obligations towards Prêt à Pousser , whatever the cause.
In case of visible damage to the package, the customer has the possibility to refuse the delivery. In the event of damage during transport, a reasoned protest must be made to the carrier and to Prêt à Pousser within 5 days of delivery. In the event of a dispute, the investigation may take up to 21 working days.
All complaints regarding defects in the goods delivered, inaccurate quantities or incorrect reference numbers must be sent to Prêt à Pousser within 72 hours of receipt of the package, failing which the right to complain will cease to exist.
In accordance with article L121-20-2 of the French Consumer Code, "the consumer has a period of seven clear days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of return and delivery costs". This period runs from receipt of the Product. If the seven-day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day. In the event of retraction, the Customer is requested to contact Prêt à Pousser customer service to request a return. The Customer must return the Product in its original packaging, together with any accessories, instructions and documentation, its return slip, customer number and order number, to the following address: Prêt à Pousser 25 ter Quai Pierre Semard, Bâtiment 6, 69350 La Mulatière. Customers may exercise their right of withdrawal without penalty. In the event of retraction, Prêt à Pousser will reimburse the amount of the Product and shipping costs. Prêt à Pousser will make the reimbursement as soon as possible, and at the latest within thirty days of the date on which the right of retraction was exercised. Reimbursement will be made by the same method used by the Customer. We invite the Customer to contact Prêt à Pousser.
Referral is a program that allows Prêt à Pousser customers to recommend our products to 5 people they know. We rely on the goodwill of our customers to use this program only in their personal circle. We therefore reserve the right to cancel and delete the referral accounts of customers who have published their referral code on other sites open to all Internet users. If a customer wishes to share this program with more than 5 acquaintances, they can contact us by email at email@example.com.
Prêt à Pousser is liable for defects in conformity of the goods with the Contract and for hidden defects under the conditions set out in Articles 1641 to 1649 of the Civil Code and Articles L211-4 et seq. of the Consumer Code. Guarantees Prêt à Pousser
If the Product is considered to be defective by Prêt à Pousser, Prêt à Pousser undertakes to offer a promotional code (valid for 1 year) equal to or greater than the value of the defective product. Any delivery costs are to be borne by the customer. The promotional code issued by Prêt à Pousser as part of the Grow Guarantee can be combined with current offers but cannot be combined with other current promotional codes. Please contact Customer Service. The guarantee of Prêt à Pousser is limited to the replacement of the product recognised as defective and which has been used in conditions in accordance with the product description. The Customer is required to submit photos of the Product so that Prêt à Pousser can conclude that the Product is defective.
The prices indicated on Pretapousser.fr are in euros, all taxes included and including VAT. The price indicated on the product sheet excludes shipping costs, which are displayed in the summary of the basket before paying.
Prêt à Pousser reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the day of the order will be the only one applicable to the buyer. The prices indicated include the cost of processing the order.
If you request delivery outside of France, your order may be subject to possible taxes and customs duties when it reaches its destination.
The payment of these duties and taxes is your responsibility and you should check with the relevant authorities in your country.
The price invoiced to the Customer is the price indicated on the order confirmation sent by Prêt à Pousser by e-mail. The price of the Products is payable in cash on the day of the order. Payment is made by bank card bearing the CB symbol (Visa, Master card) or via Paypal. The order validated by the Customer will only be considered effective when the relevant bank payment centres have given their agreement. In the event of refusal by the said centres, the order will be automatically cancelled and the Customer will be informed by e-mail.
Payment by credit card is secured via 3D secure. The security of card data transport is ensured by SSL (Secure Socket Layer) 128-bit encryption and the payment page is hosted on a bank server which ensures the integrity and confidentiality of the data collected.
As with credit card payments, Paypal guarantees the security of your bank details, so you don't have to enter your card number every time.
Prêt à Pousser shall not be held liable for any indirect damage that may arise from the purchase of the Product. Mushrooms Prêt à Pousser must be consumed cooked. Prêt à Pousser declines all responsibility for the ingestion of mushrooms and plants.
These General Conditions are subject to French law. In the event of difficulties in the application of this Contract, the Customer has the possibility, before any legal action, to seek an amicable solution. It is reminded that the search for an amicable solution does not interrupt the time limits of the legal guarantees (conformity and hidden defects). In the absence of an amicable settlement, any dispute shall be settled by the Commercial Court of Pontoise alone.
Prêt à Pousser is a brand of VIF Systems, a SAS registered with the Lyon Commercial Court under RCS 894 356 062, with capital of €300,000 and head office at 25 ter Quai Pierre Semard, Bâtiment 6, 69350 La Mulatière. Its VAT number is FR86894356062. Contractual information is presented in French. All elements of this site (photographs, illustrations, trademarks, logos, icons, etc.) are the exclusive property of the company Prêt à Pousser. These elements are protected by French laws and international texts relating to the respect of copyrights, trademarks, etc. The fact that this site is online does not imply a license to use the elements it contains, such use being subject to the express prior written consent of the owner of these elements. Any reproduction or representation, even partial, by any means whatsoever, without the prior and express written consent of Prêt à Pousser is prohibited and unlawful. Failure to comply with this prohibition constitutes an infringement of copyright, for which the infringer may be held civilly and criminally liable. Any use of elements of this site for purposes other than consultation, in particular for public, commercial or humorous purposes, may be subject to legal proceedings in France and abroad.
The personal information collected for the purposes of distance selling is mandatory, as it is essential, in particular :
- The Customer's address is useful at the time of the order in order to send the order in time, the Customer's telephone number allows the deliverymen and the Customer Service of Prêt à Pousser to contact the customer for the follow-up of his order,
- The Customer's e-mail address allows Prêt à Pousser to confirm the Customer's orders, to send the invoice, as well as to confirm any answers given by Customer Service on the phone,
This information is also used to facilitate the Customer's use of the Pretapousser.fr site, avoiding the need for multiple re-entries, and to take full advantage of all the functionalities offered by the site. The Customer's bank details (credit card number, date of validity) are encrypted using the SSL system. They are inaccessible to third parties. In accordance with the French Data Protection Act (Loi Informatique et Libertés), the processing of personal data relating to customers has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL). Customers have the right to access, modify, rectify and delete data concerning them (article 34 of the French law of January 6, 1978).
